Is your personal property protected in Nebraska?

The answer may surprise you but it is, “No!” We have all been repeatedly told that possession is nine-tenths of the law. However, that axiom is not true anymore. A recent assault on property rights has taken place, and all of us should sit up and take notice.

 

In June of 2017 the Nebraska District Judge Derek Weimer (case No. CI 13-19) in Banner County, NE, hereinafter the Court, ordered a man to pay $103,000 for personal property and vehicles that he never had possession of and that never actually existed. As a result, he is now being forced to sell his actual personal property to comply with a court order. There is 100 percent proof that the fictitious list of equipment that he was forced to pay for by the Court was never in his possession and, for that matter, never existed. In fact, the whole fictitious list was created by an adversary in court. However, in order to fit the narrative the Court wanted, it allowed (what should have been) inadmissible hearsay evidence that was fraudulently produced to be used in a court of law. The Court literally allowed a picture that was taken in 2016 of an unspecified tractor to be introduced to prove a different type of tractor existed in 1997. This happened despite the fact that documents filed in NE and WY on the Estate in question prove the tractor never existed. The Court also allowed the mere accusation that a 1988 Ford truck existed to stand as proof that it existed. This despite the fact that neither the State of Nebraska nor the State of Wyoming have any record of such a truck existing or being registered to any of the parties alleged to have owned or to have been in possession of it.

 

How does this affect you? It affects all of us. The recklessness of this Court sets a wildly dangerous precedence because it redefines the definition of personal property. Property rights have been so diminished by this case that any picture, even one taken two decades later, can be used to contrive a claim to the personal property.

How can this happen? Nebraska and U.S. Constitution have laws to protect from this happening. When you have and organize (collusion)group that are Republican Socialist Nazi that do not enforce (Fraud, Due Process) the laws of Nebraska or the United States. Banner County Republican Socialist Nazi Sheriff Stanley A. McKnight, Republican Socialist Nazi Banner County Attorney James L Zimmerman, Banner County Republican Socialist Nazi Commissioners Bob Girrord, John-Robert Faden, and Robert Post. Nebraska Attorney General Republican Socialist Nazi Doug Peterson, and Republican Socialist Nazi Governor Pete Ricketts. What is the Motivation in not enforcing the Laws.

1. Ms. Tracy Oldemeyer (plaintiff attorney) page 55 offer Exhibits 392 through 402 falsely marking them as evidence of the claim and not hearsay. (pictures Defendant had taken dated 02.12.16 Nebraska law 7-106) I believe that Ms. Tracy Oldemeyer of Cline Williams Wright was in collusion with the Defendant attorney.

2. Page 228-229 Ms. Tracy Oldemeyer asks Defendant about the pictures that he had taken. Dates 02.12.16 (taken from a county road, 19 years after Daniel O Mosher’s Death, they do not show proof of ownership. Nebraska law 60-140

3. Page 270 Defendent states that the tractor he sat on is in picture Exhibit 392 and Dad’s 1988 Ford Truck is in the picture Exhibit 398 (picture shows a John Deere 4650 Tractor not the 4755 tractor)(Daniel Mosher never own a 1988 ford grain truck see title search records, Nebraska law 77-3522, 60- 142, 60-140 “No court shall recognize the right, title, claim, or interest of any person in or to a vehicle , for which a certificate of title has been issued in Nebraska, sold, Disposed of, mortgaged or encumbered, unless there is compliance with this section.”)

4. Mr. Sorensen Direct examination Defendent Page 552 Exhibit 398 you can see the farm truck and the trailer. The Court Judge Weimer “I can see it the way he was holding it.” (The picture in question has no Gooseneck trailer or any other similar type trailer. Nebraska law 7-106)

5. The Judge Wiemer signed an order to attach Leonard Mosher farm equipment and move it to the Banner County fenced dump. The Banner County sheriff was not at the trial because it was held in Kimball County. The Banner Co. sheriff made a list of equipment taken. There was no Hillsboro Gooseneck trailer on the list, but pictures of the fenced county yard show a Hillsboro Gooseneck Trailer. Neither Lois Mosher or Daniel Mosher owned a gooseneck trailer. A Nebraska title search shows VIN: 5849 Model: HI-18-4L3-TW, Title Number: 0071E005172 county: 71 Kimball , issued: 01/25/1974, Name: H*************(Fraud) Judge Weimer and/or Defendants and their attorneys and/or the Banner County Sheriff, are trying to match the trial and Judge Weimer order Case No. C113-19.

6. The flatbed trailer listed Vehicle Identification Number has 18 Digits, VIN numbers are 17 Digits. Sheriff list (8) the Model number FB16E, I have the Certificate of Origin for a Vehicle on this trailer, Leonard Mosher own it and I use it on farm not highway so I never titled it, but this is not a homemade trailer. (see copy of Certificate of origin For a Vehicle. VIN No. nebraska7016F185350075DXS)

7. Sheriff list (63) Old Red ford grain truck, No VIN No. listed. All other equipment has serial No. or VIN No. but not this truck. Pictures of old red ford truck in fence yard and proof this is not the 1988 ford grain truck.

 

No documents were entered into evidence that proved that Daniel Mosher or Lois Mosher owned any of the equipment listed. Exhibit #122 pg.3 shows that he was half owner of a 1978 Ford truck. However, a Affidavit For Collection and Distribution of Decedents’ Personal Property signed by Lois Mosher after the death of Daniel Mosher shows that upon his death Daniel Mosher only owned two vehicles, a Lincoln Town Car and an Oldsmobile car.

The court determines that the Defendants have demonstrated that the plaintiff has converted the items listed above to personal use. (Due Process)
Theft of Equipment
The Defendants assert that certain specific items of personal property which ought to have been trust assets were disposed of, Kept or stolen by plaintiff. He denies that he has any of the items. The items are identified as follows:

John Deere 4755 Tractor 1988 ford grain truck
John Deere 7700 Combine Ford Loader tractor

Hillsboro gooseneck trailer Flatbed utility trailer

Disk, Chisel, grain drills
Various farm equipment and plows Various shop tools and old tractors

Surname Mosher is Jewish. I believe Nebraska District Judge Derek Weimer is Anti-Semitic.

 

Complaint Evidence

In Judge Wiemer’s statement equipment was kept or stolen by the plaintiff. According to Nebraska 28-511 criminal code ownership needed to be establish before a judge states that plaintiff stole, not doing such is a breach of Due process (Nebraska Constitution Article 1-3 Paragraph 16, 18, 27)

 

Wyoming Uniform Trust Code (Acts. 1-11) Article 4. 4-10-412 “(f) If not all of the beneficiaries consent to a proposed modification or termination of the trust under subsection (a) , (b), or (c) of this section, the modification or termination may be approved by the court if the court is satisfied that: (ii) The interests of the beneficiary who does not consent will be adequately protected”

 

as well as

 

Nebraska Revised Statute 30-3837 A Irrevocable trust cannot be modified or terminated without consent by its beneficiaries without the beneficiaries interested being protected. This decision specifically changes the trust to damage one of the beneficiaries.

 

8.  Ms. Tracy Oldemeyer (plaintiff attorney Would not Appeal Judge Wiemer Order. I believe that Ms. Tracy Oldemeyer of Cline Williams Wright Johnson & Oldfather LLP was in collusion with the Defendant attorney.

 

9.  I believe that Ms. Tracy Oldemeyer covered up that Lois A Mosher died of Parkinson’s Disease which would have voided the first and second amendment of the trust. By covering this up  I believe that Ms. Tracy Oldemeyer of Cline Williams Wright Johnson & Oldfather LLP was in collusion with the Defendant attorney.

Due Process

Due process is the legal requirement that the state must respect all legal rights that are owed to a person. Due process balances the power of law of the land and protects the individual person from it. When a government harms a person without following the exact course of the law, this constitutes a due process violation, which offends the rule of law.
